Under a draft to amend and supplement the Government's Decree 125/2020/ND-CP on administrative sanctions for violations of tax and invoice regulations, the Ministry of Finance has proposed classifying the failure to issue invoices into five different levels.
Infraction levels will correspond to fines of 1 million VND to 80 million VND, depending on the nature and number of invoicing violations.
The highest fines, from 60 million VND to 80 million VND, will be applied in cases where businesses failed to issue 50 or more invoices when selling goods or providing services, according to the regulations.
Low-level fines of 1-2 million VND will be applied to sellers who did not issue 1-9 invoices for goods and services that are used for promotion, advertising, sample making, gifts or exchanges for customers, or for paying in lieu of salary for employees (except for goods circulated internally for production).
In addition, the draft decree also proposes expanding the group that is subject to administrative fines for violations in the field of taxes and invoices.
If taxpayers authorise other organisations or individuals to perform tax obligations according to regulations, the authorised organisations or individuals will be fined if they commit violations. /.VNA
